Terms and Conditions for Bensons for Beds’ Copenhagen City Break giveaway.

These Terms and Conditions (the “Terms”) provide the opportunity for a customer who purchases any Tempur mattress or Tempur bed frame (“Tempur Mattress/Bedframe”) with Bensons in-store or via our website at bensonsforbeds.co.uk during the Promotion Period (“Eligible Customer”) to win a 3 night City Break to Copenhagen (3 nights’ accommodation and return flights from the UK) for two people (the “Promotion”).

By entering the Promotion, the Eligible Customer will be deemed to be bound by and have accepted these Terms which prevail in the event of any conflict or inconsistency with any other communications in respect of the Promotion, including advertising or promotional materials.

Promoter:

The Promotion is promoted by Bensons for Beds Retail Ltd (Company Number: 12528962) of 3rd Floor, The Globe Centre, 1 St James Square, Accrington, Lancashire, BB5 0RE, United Kingdom (“Bensons”).

Eligibility:

1. The Promotion opens at 12:01am on 27th March 2024 and will close at 11:59pm on 15th May 2024 (the “Promotion Period”).
2. The Promotion is open to UK (England, Scotland, and Wales) residents aged 18 or over, excluding employees of Bensons, their immediate families, agents or anyone else professionally connected with the Promotion.
3. Only one entry per Eligible Customer will be accepted even if an Eligible Customer purchases more than one Tempur Mattress/Bedframe in an order and/or makes more than one order of Tempur Mattress/Bedframe during the Promotion Period Multiple or third party entries are not permitted.
4. To enter the Promotion an Eligible Customer must place an order with Bensons for Beds for Tempur Mattress/Bedframe during the Promotion Period and then email their order number to competitions@bensonsforbeds.co.uk prior to the end of the Promotion Period.
5. Anyone trying to circumvent these entry rules by using alternative details including, but not limited to, creating multiple email accounts will be disqualified from this Promotion. Entries (bulk or otherwise) made from trade, consumer groups or third parties will not be accepted. If it becomes apparent that an Eligible Customer is using a computer(s) to circumvent this condition by, for example, the use of ‘script,’ ‘brute force’ or any other automated means, that Eligible Customer’s entries will be disqualified and any prize award will be forfeited.
6. An Eligible Customer must make an order of Tempur Mattress/Bedframe and email their order number to competitions@bensonsforbeds.co.uk during the Promotion Period in order to participate in the Promotion. Internet access is also required if you order on-line as well as the need to provide an email address.

Entry Requirements:

7. Orders for Tempur Mattress/Bedframe placed and emails with order numbers sent outside of the Promotion Period and cancelled orders for Tempur Mattress/Bedframe will be excluded.
8. Incomplete, illegible, misdirected or late entries will not be accepted. Proof of sending will not be accepted as proof of delivery. Bensons takes no responsibility for entries delayed, incomplete or lost due to technical reasons or otherwise and its decision is final.
9. This is a game of chance and skill plays no part in determining the winner.

Winner Selection and Notification

10. After the closure of the Promotion and, at the latest by, 11:59pm on 29th May 2024, the winner of the Promotion shall be selected at random.
11. The winner will be notified by email to the address that the Eligible Customer provided to Bensons in accordance with clause 4 above by 11:59pm on 12th June 2024.
12. All reasonable efforts will be made to contact the winner. However, if a prize claim response has not occurred within four weeks of Bensons notifying the Eligible Customer that they have won then an alternative winner to the original winner may be selected. In this instance, the original winner will forfeit any right to the Prize.

Prize

13. The Prize is :
• Return flights from the UK to Copenhagen for 2 people.
• 3 nights’ accommodation in a 4 star hotel for 2 people

Specific details of the Prize will be discussed with the winner at the time the Prize is won and whilst Bensons will endeavour to accommodate the winner if possible the specific flights and accommodation will be specified by Bensons. For the avoidance of doubt the Prize does not cover any transport to and from the airport, any meals and/or spending money.

14. The Prize cannot be transferred, exchanged or redeemed for cash. No alternative prize is available to the Prize.
15. Bensons will not be liable if the Prize cannot be taken by a winner for any reason beyond the control of Bensons.

General

16. Bensons reserves the right to cancel or amend the Promotion or these Terms at any stage but will always endeavour to minimize the effect to Eligible Customers if it can in order to avoid undue disappointment.
17. Bensons shall not be liable for any technical issues, system or software failures encountered in respect of the Promotion.
18. Bensons reserves the right to verify all entries from Eligible Customers and the winner(s) and to refuse to award the Prize or withdraw the Prize and reclaim any Prize paid where there are reasonable grounds to believe there has been a breach of these Terms or any instructions forming part of the Promotion or otherwise where an Eligible Customer has gained an unfair advantage in participating in the Promotion or won using fraudulent means or subsequently returned the Tempur Mattress/Bedframe purchased for any reason. Bensons decision is final in all matters relating to the Promotion these Terms and/or the Prize.
19. By entering the Promotion an Eligible Customer consents to their personal details being used in relation to the Promotion and for marketing purposes unless the Eligible Customer withdraws their consent in writing to Bensons which can be done at any time. Unless it is not permitted to do so, Bensons will send the name and county of the winner to anyone who writes within one month after the closing date of the Promotion requesting details of the winner and who encloses a self-addressed envelope to 3rd Floor, The Globe Centre, 1 St James Square, Accrington, Lancashire, United Kingdom, BB5 0RE. The winner or Eligible Customer may also be asked to participate in further publicity unless the winner or Eligible Customer withdraws their consent in writing to Bensons to do this.
20. Other than for death or personal injury arising from the negligence of Bensons, and as far as permitted by the law, Bensons hereby excludes all liability for any loss, damage, cost and expense, whether direct or indirect, howsoever caused in connection with the Promotion, these Terms or any receipt, use or misuse of the Prize.
21. Bensons will use personal data supplied by an Eligible Customer to contact them should they win and also in relation to the Promotion as described in clause 19 unless an Eligible Customer withdraws their consent as also set out in clause 19.. This personal data shall be stored, handled and process in accordance with applicable data protection and electronic marketing legislation, including but not limited to the Data Protection Act 2018, the UK General Data Protection Regulation and the Privacy and Electronic Communications (EC Directive) Regulations 2003 (as amended). 22. Eligible Customers agree to keep these Terms confidential.
23. These Terms and any issues or disputes which may arise out of or in connection with these Terms (whether such disputes or issues are contractual or non-contractual in nature, such as claims in tort, for breach of statute or regulation or otherwise) shall be governed by and construed in accordance with the law of England and Wales. Eligible Customers hereby irrevocably submit to the exclusive jurisdiction of the English & Welsh courts to settle any such dispute or issues.
