These Terms and Conditions apply to Bensons for Beds’ mattresses giveaway (the “Terms”) and provide you, our customer, with the opportunity to win the cash value of any iGel, Sealy Posturepedic or Tempur mattress order you place with Bensons for Beds in-store or via our website at bensonsforbeds.co.uk from 12:01am on 20th March 2024 and will close at 11:59pm on 26th March 2024 (the “Promotion”).

By entering the Promotion, you will be deemed to be bound by and have accepted these Terms which prevail in the event of any conflict or inconsistency with any other communications in respect of the Promotion, including advertising or promotional materials.

Promoter:

The Promotion is promoted by Bensons for Beds Retail Ltd (Company Number: 12528962) of 3rd Floor, The Globe Centre, 1 St James Square, Accrington, Lancashire, BB5 0RE, United Kingdom.

Eligibility:

1. The Promotion opens at 12:01am on 20th March 2024 and will close at 11:59pm on 26th March 2024 (the “Promotion Period”).
2. The Promotion is open to UK (England, Scotland, and Wales) residents aged 18 or over, excluding employees of the Promoter, their immediate families, agents or anyone else professionally connected with the Promotion.
3. Only one entry per person will be accepted. Multiple or third party entries are not permitted.
4. To enter the Promotion entrants must place an order with Bensons for Beds during the Promotion Period and then email their order number to competitions@bensonsforbeds.co.uk prior to the end of the Promotion Period.
5. Anyone trying to circumvent these entry rules by using alternative details including, but not limited to, creating multiple email accounts will be disqualified from this Promotion. Entries (bulk or otherwise) made from trade, consumer groups or third parties will not be accepted. If it becomes apparent that a participant is using a computer(s) to circumvent this condition by, for example, the use of ‘script’, ‘brute force’ or any other automated means, that person’s entries will be disqualified and any prize award will be forfeited.
6. The making of an order to participate in the Promotion is necessary. Internet access is also required if you order on-line.

Entry Requirements:

1. Orders placed outside of the Promotion Period and cancelled orders will be excluded.
2. Incomplete, illegible, misdirected or late entries will not be accepted. Proof of sending will not be accepted as proof of delivery. The Promoter takes no responsibility for entries delayed, incomplete or lost due to technical reasons or otherwise.
3. This is a game of chance and skill plays no part in determining the winner.

Winner Selection and Notification

1. After the closure of the Promotion and, at the latest by, 11:59pm on 2nd April 2024, the 3 x winners of the Promotion shall be selected at random.
2. The winners will be notified by email to the address that you provided to us when you made the order by 11:59pm on 23rd April 2024.
3. All reasonable efforts will be made to contact each winner. However, if a prize claim response has not occurred within four weeks of us notifying you that you have won then an alternative winner picked at the same time as the original winner may be selected. In this instance, the original winner will forfeit their prize.

Prize

1. There are three prizes to be won by three different individual winners. The prize is a refund of the lesser of (i) the total value of the 1 x iGel, Sealy Posturepedic or Tempur mattress order (including VAT) that the winner submitted as part of their entry to the Promotion; or (ii) £2000 (each a “Prize”).
2. Prizes cannot be transferred, exchanged or redeemed for cash. No alternative prize is available.
3. The Prize will be deposited into the bank account from which payment for the order was made.
4. The Promoter will not be liable if the prize cannot be taken by a winner for any reason beyond the control of the Promoter including if a winner fails to provide the correct bank account details.

General

1. In exceptional circumstances outside its reasonable control, the Promoter reserves the right to cancel or amend the Promotion or these Terms at any stage but will always endeavour to minimise the effect to entrants in order to avoid undue disappointment.
2. The Promoter shall not be liable for any technical issues, system or software failures encountered in respect of the Promotion.
3. The Promoter reserves the right to verify all entries and the winner(s) and to refuse to award the Prize or withdraw the Prize and reclaim any Prize paid where there are reasonable grounds to believe there has been a breach of these Terms and Conditions or any instructions forming part of the Promotion or otherwise where a participant has gained an unfair advantage in participating in the Promotion or won using fraudulent means or subsequently returned the iGel, Sealy Posturepedic or Tempur mattress purchased for any reason.
4. Unless you otherwise object, we will send the name and county of the winner to anyone who writes within one month after the closing date of the promotion requesting details of the winner and who encloses a self-addressed envelope to 3rd Floor, The Globe Centre, 1 St James Square, Accrington, Lancashire, United Kingdom, BB5 0RE. You may also be asked to participate in further publicity which we will discuss and obtain your consent to prior to doing so.
5. Other than for death or personal injury arising from the negligence of the Promoter, so far as permitted by the law, the Promoter hereby excludes all liability for any loss, damage, cost and expense, whether direct or indirect, howsoever caused in connection with the Promotion or any receipt, use or misuse of the Prize.
6. Bensons for Beds will only use personal data supplied by entrants to the Promotion for the purposes of its administration, unless consent is received to use such information for any other purpose. This personal data shall be stored, handled and process in accordance with applicable data protection and electronic marketing legislation, including but not limited to the Data Protection Act 2018, the UK General Data Protection Regulation and the Privacy and Electronic Communications (EC Directive) Regulations 2003 (as amended). 7. Personal details will be used to contact winners only and any email addresses (if collected) will not be retained for marketing purposes.
8. These Terms and any issues or disputes which may arise out of or in connection with these Terms (whether such disputes or issues are contractual or non-contractual in nature, such as claims in tort, for breach of statute or regulation or otherwise) shall be governed by and construed in accordance with the law of England and Wales. Entrants hereby irrevocably submit to the exclusive jurisdiction of the English & Welsh courts to settle any such dispute or issues.
